New charge of CC s.365 issued - April 2009

Below is a Toronto Sun article forwarded by Peter Siegel. Batura Draame of Toronto, Ontario, the Defendant, is charged with various fraud offences and CC. s.365. The frequency with which this charge has been issued over the last decade is of concern, especially given that the British law upon which s.365 was based has long since been repealed. "Witch" and "witchcraft" are terms used, often derogatorily, to refer to the practices of non-Christian cultures despite the practices being identical or similar in essence. It appears that only non-Christian defendants of fraud are subject to an additional charge based on their cultural practices via CC s.365.

Man charged with pretending to practise witchcraft

A Toronto man is accused of pretending to practise witchcraft while defrauding a victim out of a chunk of cash.

The victim sought out the services of a "spiritual leader" in March, then met with the accused and another man several times during the weeks that followed, a Toronto Police press release said Friday.

It was during the final meeting that the victim was duped out of "a substantial amount" of money, Acting Staff-Sgt. Frank De Lio said.

Batura Draame, 30, was arrested Thursday on charges of fraud over $5,000, false pretence over $5,000, pretending to practice witchcraft, theft over $5,000, and two counts of possession of property obtained by crime over $5,000.
